These Terms govern your use of the Screen Star iPhone app and the getscreenstar.com website (together, the "Service"). The Service is operated by Nam Bui, a sole proprietor based in New York ("Screen Star," "we," or "us"). By installing, opening, or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
These Terms incorporate our Privacy Policy by reference.

Screen Star is a screen-time utility for iPhone. It uses Apple's Family Controls and DeviceActivity frameworks to help you set a daily time budget on apps and categories you choose, displays usage charts, optionally shields blocked apps, and shows a cartoon mascot that reacts to your behavior.
Screen Star is not a medical device, therapy, addiction treatment, or substitute for professional help. It is a self-directed productivity and habit tool.
You must be at least 13 years old to use Screen Star, and old enough in your country to enter into a binding contract. If you are under the age of majority where you live, you may only use the Service with permission and supervision from a parent or legal guardian who agrees to these Terms on your behalf.
Screen Star uses Family Controls in its individual-device mode. It is not designed or marketed as a parental-control product.
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Screen Star on Apple-branded devices that you own or control, for your own personal, non-commercial use. All other rights are reserved.

Screen Star offers an auto-renewable subscription that unlocks paid features. By starting a subscription you agree to the following terms, which are standard for App Store subscriptions:
You agree not to use Screen Star to do anything illegal, to circumvent Apple's Family Controls protections in a way that harms another person, or to interfere with the Service's normal operation (e.g., by attacking our servers, abusing the website's API, or attempting to falsify subscription receipts). We may suspend access to the Service if you do.
Screen Star, including the yellow-star mascot characters and all related artwork, the app and website code, the visual design, the brand name, and all related materials, is owned by Nam Bui and protected by U.S. and international copyright, trademark, and other intellectual-property laws. These Terms do not transfer any ownership to you.
Anything you create within the app that stays on your device (your settings, your budget, your streaks) is yours.
Screen Star is a self-help tool, not a healthcare product. It does not diagnose, treat, cure, or prevent any condition, including but not limited to internet addiction, anxiety, depression, ADHD, or any compulsive behavior. If you are struggling with your relationship to your phone in a way that affects your health, please talk to a qualified professional.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.
We do not warrant that Apple's Screen Time frameworks (Family Controls, DeviceActivity, ManagedSettings) will perform without error or that usage data, thresholds, shield triggers, widgets, or notifications will always be accurate or on time. These are Apple system features that we use as Apple provides them.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SCREEN STAR OR NAM BUI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless Nam Bui from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
You can end this agreement at any time by deleting the app and cancelling any active subscription through Apple. We can suspend or terminate your access if you materially violate these Terms or if continuing to provide the Service to you would expose us to legal risk. Sections that by their nature should survive (IP, disclaimers, liability limits, indemnity, governing law) will survive termination.
These Terms are between you and Nam Bui. They are not with Apple. Because Screen Star is distributed through Apple's App Store, the following apply (Apple requires them):
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution first. Before filing any claim, you agree to try to resolve the dispute informally by emailing [email protected] with a description of the issue. We'll do the same. If we can't resolve it within 60 days, either of us can pursue formal action.
Venue. Any lawsuit must be brought in the state or federal courts located in New York County, New York, and you and we consent to personal jurisdiction there. You and we both waive any right to a jury trial to the extent permitted by law.
Nothing in this section prevents either party from seeking relief in small-claims court for qualifying disputes, or from seeking injunctive relief in any court of competent jurisdiction to protect intellectual property.
We may update these Terms when the Service changes or the law requires. If we make material changes, we'll update the "Last updated" date and surface a notice in the app the next time you open it. Continuing to use the Service after a change means you accept the updated Terms.
